Springville man arrested for theft after having renter’s car towed
A Springville man was charged with three counts of theft of property Friday after he allegedly had vehicles towed from a rental home he owns in an attempt to collect a debt.
James C. Breer, 53, was arrested by Henry County Sheriff’s Sgt. Blake Jenkins at a home off Highway 79 northeast of Paris.
He was charged with theft greater than $10,000 but less than $60,000; theft greater than $1,000 but less than $10,000; and theft greater than $500 but less than $1,000.
According to the report by Jenkins, the owner of one of the vehicles rents a home from Breer, and had left in mid-December on a work trip.
While the alleged victim was on the road, Breer texted him and said since he owed him money from a prior vehicle, he was going to tow the victim’s current red 2012 Chevrolet 1500 pickup and keep it until he got his money.
A few days later, he was told by Sheriff’s deputies that it was a civil matter, and he could not tow the victim’s vehicle just because he owed him money.
When the victim returned home, he found that not only had the pickup been taken from the home’s garage, a black 2007 Chevrolet Cobalt belonging to a relative had been taken, and a Black Jeep Cherokee belonging to a friend was missing as well.
Jenkins said he noticed the pickup on a trailer during a Dec. 30 visit to Breer’s home, but wasn’t aware at the time it had been stolen.
Breer was released on a $15,000 bond. He is set to appear Tuesday in Henry County General Sessions Court.

regardless of his intentions the law provided a loophole by granting him the authority TCA 66-28-519 to have all of them towed from his rental property !
